07 Feb Homeowners in Brgy. Macasandig Urge Gov’t to Halt Construction of Cemetery
In a report from Sun.Star, homeowners of two subdivisions in Barangay Macasandig namely; the Melecia Homes Subdivision Homeowners Association, and Arrowville Subdivision Homeowners Association want the construction of cemetery near their area to be stopped through asking the Regional Trial Court Branch 41 to issue a temporary restraining order against Forest Lake Memorial Park.
As argued in the motions filed by the Pryce Corporation, the Forest lake Memorial Park was said to have violated the city’s zoning ordinance as its 3-hectare memorial park will be established in the neighborhood of the two mentioned subdivisions.
It was stated that in the petition created by the residents, the City Council in the year 2014 approved the City Ordinance no. 12796-2014 which allows preliminary approval and location clearance for the said memorial park, however, the residents argued that the Council just based it in an opinion coming from the City Planning and Development Office (CPDO). Such opinion from the CPDO stated that the project can be built in the residential, industrial or commercial zones, of which open/park spaces are required, for as long as the project is park-like in nature.
According to Odilon Apolinario, a lawyer, allowing such project “is a mockery of law and prejudicial to the public and general welfare”, as quoted from Sun.Star. The homeowners then added that if the memorial will be allowed, they would be suffering from irreparable injury, to mention their peace, health and environmental concerns.
