16 Sep Pagatpat’s Barangay Chairman Apprehended for Rape Case
On September 14, Wednesday, the authorities apprehended Barangay Pagatpat’s chairman, Achilles Jude Babaran after almost three weeks of hiding. Babaran was wanted for two counts of rape.
Babaran was admitted at JR Borja Memorial City Hospital as he suffers from chest pains. The authorities then obeyed the warrant of arrest against him on Wednesday evening. He is now under hospital arrest.
Babaran was admitted initially at the Maria Reyna Hospital and was only transferred last Wednesday, said by a close relative.
Cagayan de Oro City Police Office (Cocpo) chief, Senior Superintendent Ronnie Francis Cariaga said that a concerned citizen reported to them about Babaran’s presence at the hospital.
Two counts of rape against a fifteen-year-old girl who was found murdered, in a separate incident, by an unknown assailant in a hotel room in Cagayan de Oro City were filed against Babaran since August 26.
The victim’s family said that justice cannot be attained until Babaran is imprisoned. The victim’s sister said, “Nalipay mi pero dili pa gayud ingana kadako ang among kalipay kay naa raman siya sa hospital, gusto gayud namo makita siya nga naa na sa prisohan.”
She added that Babaran just pretended to be ill to prevent him from being imprisoned.
“Posible gayud nga palakat lang na niya ng magpa-hospital. Nagtuo mi nga special treatment ang nahitabo kay grabe ang pagprotektar sa police sa iyaha unya dili gayud siya maistorya,” she said.
She added, “Pero mapasalamaton gihapon mi nga nadakpan na siya ug nagapsalamat mi sa mga tao nga naglocate sa iyaha.”
Babaran’s physician has yet to issue a certificate of confinement, Chief Inspector Allan Curato, Cocpo spokesperson said. As he spoke, “Wala pa ta kabalo kung unsay reason sa iyang pagka-hospital kay wala paman nag-issue ug certificate of confinement, kay naa man daw sila 24 hours to issue.”
Curato added, “Depende gihapon sa doctor kung muingon na pwede na mapagawas, maggawas na nato siya sa hospital but kung muingon nga dili pa pwede, wala gayud tay mahimo, i-hospital arrest gayud siya.”
Babaran will be brought to the Regional Trial Court Branch 37 before going to the Lumbia City jail, once he’s discharged from the hospital.
Curato stated, “Kung beyond 5 in the afternoon, wala pa gihapon siya magawas sa hospital, sa Maharlika Detention gayud namo siya madala because the court closes at 5 p.m.”
