#BeInformed: Subdivisions Are Not Allowed To Ask For Driver’s License Of Visitors, According To PH Law

Mga higala! As you may know, it has been a common protocol for subdivision security guards to ask for the driver’s license of their visitors, in most subdivisions in the Philippines.

However, according to Atty. Noel Del Prado in a recent interview with DZMM, this practice is a violation of the law.

Prado explained that only the officers of the Land Transportation Office (LTO) have the power to ask for a driver’s license, as stated in Section 19 of Republic Act 4136 or the Land Transportation and Traffic Code.

He also added that this restriction is also specified in Section 12 of Resolution 001 series of 2017 of the Housing and Land Use Regulatory Board (HLURB):

“[It shall be prohibited] to require the driver of any vehicle entering the subdivision or condominium to surrender his/her driver’s license. The association is not authorized under the traffic laws to take custody, even on a temporary basis, the license issued by the Land Transportation Office.” 

A fine of 5,000 to P50,000 will be issued to security guards or homeowner officials who will violate this law.
